Artivive GmbH ( “Artivive”, “we”, “our”, “ours”, “us”), is an Austrian startup founded in 2017, aiming to change how art is created and consumed. Artivive is the leading platform for augmented reality art, where artists can create new dimensions of art by enhancing physical artworks with a digital layer. Our vision is to bridge the gap between classical and digital art and to provide museums and galleries with the infrastructure to deliver an immersive experience for their visitors.
Introduction
These Terms of Service (“Terms”) form a binding legal agreement between you (“Attendee” or “you” or “your”) and Artivive GmbH. These Terms govern your registration for and attendance of the Event. By registering for the Event you will have deemed to have made a firm booking and to have accepted these Terms.
Fees and Registration Confirmation
You agree to pay all fees in accordance with the current applicable rates available on our website and you will provide complete and accurate billing and contact information and notify us of any changes to such information. The payment of the applicable fee for the Artivive’s Virtual Event is due upon registration. If such payment is insufficient or declined for any reason Artivive may refuse to allow you to access the Virtual Summit and shall have no liability in that regard.
Upon completing your registration, you will receive your registration confirmation and invoice by email.
Updating Terms
We maintain the right to update or modify any of these Terms without prior notice to you. It is recommended that you check every now and again for changes to these Terms yourself. Should there be any significant changes, we will notify you via email.
Participant Requirements
By participating in the Virtual Event you acknowledge and agree to grant Artivive the right at the Virtual Summit to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to Artivive includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

Please note that if you do not cancel and do not access the Virtual Summit, you are still responsible for payment.
Privacy and Confidentiality
Any personal information you provide us with (including any provided by you in connection with setting up your account) shall be governed by and subject to our Privacy Policy, which determines the collection and use of personal information. Except as expressly and unambiguously permitted hereunder, you agree to hold in confidence and not use or disclose any materials or information disclosed by us, our affiliates, or our licensors, that are confidential or proprietary or which may be reasonably regarded as the confidential information of the other party (“confidential information”). Confidential information will not include any materials or information that you can prove:
Is now, or later becomes, through no act or failure on your part, generally known or available to the public;
Is known by you at the time of disclosure as evidenced by written record, without obligation of confidentiality;
Is furnished to you by a third party, as a matter of right and without restriction on disclosure;
Programme changes
You acknowledge and agree that Artivive, in its sole discretion, reserves the right to change any and all aspects of the Virtual Summit , including but not limited to, the Virtual Summit name, speakers, performers, hosts, moderators, venue, and time.
Prohibited Conduct
By registering for Artivive’s virtual summit you agree not to sell, trade, transfer, or share your complimentary access link and/or code, unless such transfer is granted by Artivive.
As a condition of Your participation in a Program, You also agree that You will not impersonate any person, or falsely state or otherwise misrepresent Your affiliation with any person. You may not instigate or encourage others to commit illegal activities or cause injury or property damage to any person, and You may not post or transmit any unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind.
You acknowledge and agree that Artivive reserves the right to remove you from the Virtual Event if Artivive, in its sole discretion, determines that your participation or behaviour creates a disruption or hinder the Virtual Event or the enjoyment of the Virtual Event content by other attendees.
Acceptable use
In attending the Event, you agree to comply at all times with all applicable laws. You may not knowingly:

Intellectual property rights
Nothing herein shall be construed as transferring to you or any third party any right, title, or interest in or to any content, presentation, documentation, or other materials provided in connection with the Event (the “Content”).
Limitation of liability
In no event shall We be liable to you for any incidental damages. Except for such losses that cannot be excluded by mandatory law, in no event shall our aggregate liability for damages in connection with your registration for the Event exceed the amount you paid for the Event.
Indemnification
You agree to indemnify, defend, and hold Us harmless from and against any and all losses, liabilities, costs (including reasonable legal fees) or damages resulting from any claim by any third party arising out of any act or omission by you during or in connection with the Event or the Content or your registration for the Event.
Salvatory Clause
If any part of these Terms is found void and unenforceable, it will not affect the validity of the balance of the Terms, which shall remain valid and enforceable according to its terms. The failure of a party to insist on the performance of an obligation hereunder shall not be deemed to be a waiver of such obligation or of any other obligation. The parties acknowledge and agree that your material breach of these Terms adversely affecting our proprietary rights would cause irreparable harm to us, for which a remedy at law would be inadequate and that we shall be entitled to injunctive relief in addition to any remedies it may have hereunder or at law.
